WhatsFlirt Terms of Service and User Agreement

1. Acceptance of Terms

Our name, logos, product and service names, designs, and slogans are trademarks of WhatsFlirt or its affiliates. You must not use such marks without our prior written permission.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial use. No right, title, or interest in or to the Services is transferred to you.

You retain ownership of your User Content. However, by posting User Content, you grant WhatsFlirt a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and providing the Services.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall WhatsFlirt, its affiliates, directors, employees, licensors, or service providers be liable for any indirect, special, incidental, consequential, punitive, or exemplary damages arising out of or relating to your use of, or inability to use, the Services.

This includes, without limitation, damages for loss of profits, goodwill, data, or other intangible losses, even if we have been advised of the possibility of such damages. Our total cumulative liability to you for all claims arising from or related to the Services shall not exceed the greater of (a) the amount you have paid to WhatsFlirt in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

6. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WHATSFLIRT DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, error-free, or free from harmful components. We do not warrant that any defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components.

We are not responsible for the conduct, whether online or offline, of any user of the Services. We do not warrant the accuracy, completeness, or usefulness of any information on the Services or endorse any opinions expressed via the Services.

7. Termination

We may, at our sole discretion, suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including, but not limited to, if we believe you have violated these Terms.

You may terminate your account at any time by following the instructions within the Services or by contacting us. Upon termination, your right to use the Services will cease immediately. 8. Governing Law & Dispute Resolution

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal or state courts located in Wilmington, Delaware. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

We each agree to resolve any dispute through binding arbitration or small claims court on an individual basis, not as part of a class action. You waive your right to a jury trial.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect.
